EDSBORG TERMS AND CONDITIONS

GENERAL

1.1. SCOPE OF APPLICATION

These general terms and conditions of sale (hereafter “T&C“) as well as the relevant “Privacy Policy” are applicable to the internet site www.edsborg.se (hereinafter the “Online Store”) that Edsborg Sverige AB (“Edsborg”), makes available to internet users, offering the  products and services produced and distributed under the trademarks owned and/or licensed to or by Edsborg (hereafter all together the “Product(s)” and/or the “Service(s)“).

Edsborg is domiciled at Klockaregränd 19, 732 32 Arboga, Sweden, Swedish corporate identity number 559190-2407.

By accessing and using the Online Store, ordering or buying Products or Services from the Online Store, the customer (hereafter “Customer” or “you“) declares to have fully read and understood, and to accept, all the terms and conditions included in these T&C.

These T&Cs may be amended from time to time. The T&Cs applicable are those accepted by the Customer when placing an order.

1.2. THE CUSTOMER

The Customer, by placing an order through the Online Store declares to know that we sell Products and Services to non-trade Customers acting in their capacity as consumers.

The Customer also declares and warrants to be (i) legally capable of entering into binding contracts and (ii) of age, i.e. in most countries aged eighteen (18) years of age or more.

In general, Edsborg reserves the right to refuse any order of Products of an abnormal nature, in particular in the event of orders in quantity and/or for amounts which would be reasonably deemed abnormal by Edsborg.

PRODUCTS AND SERVICES, PRICES, ORDER

2.1. PRODUCTS AND SERVICES AND PRICES

Products and Services are described and presented as accurately as reasonably necessary. However, if you have any questions concerning any Product or Service or your order, please contact us at info@edsborg.se and we will try to assist you in the best possible way.

Our mysteries take place in city centres, and you will move around on city streets and squares. The total distance will probably be a few kilometres, although that varies from one location to another. It might be necessary to walk up or down flights of stairs et cetera, but with a friendly helper most people should be able to get a hold of the clues. 

In the winter some clues might be covered by snow or might even have been removed, depending on the location. If you notice that a clue is missing, please let us know at info@edsborg.se

The prices for our Products and Services are those indicated on the Online Store at the time of the order, which the Customer will have the chance to review prior to the confirmation of the order. The Customer acknowledges that Edsborg may revise the pricing for the Products and Services of the Online Store from time to time. Edsborg also reserves the right to change without notice the terms and conditions of all promotional campaigns.

Prices are indicated in the Swedish currency krona (“SEK”). Unless otherwise expressly stated, the price of the Product or Service shown does not include delivery costs (hereafter “Delivery Costs“).

All intellectual property rights in respect of the Products are the property of Edsborg, and/or its licensors. The Customer acknowledges that the copying, or any form of unauthorized dissemination, wholly or partly, of any Product is hereby expressly prohibited. In addition, the Customer undertakes not to divulge information in any form, including without limitation in the form of pictures, regarding any clue forming part of Product.

2.2. ORDER PROCESS

To finalize and place the order, the Customer shall confirm the data, select shipping method, declare to have read and explicitly accept the T&C and place order giving access to secure payment of the order. An order is only considered placed when a Customer submits it through our online purchase process.

If any Customer’s order is cancelled in accordance with Section 5, below, after Edsborg has processed such Customer’s payment, Edsborg will refund your payment.

The Customer acknowledges and accepts that once the order is sent (after confirmation by the Customer), the Customer cannot modify it, although the Customer may make use of his/her right of cancellation if applicable pursuant to Section 5 below.

PAYMENT

Products and Services shall be paid for in SEK.

The Customer shall bear all compulsory taxes and fees and potential bank charges. Tax will depend on the Customer’s country for product delivery and, where applicable, VAT or the equivalent local tax will be specified on the order confirmation. Likewise, the Customer may have to pay import duties and taxes levied. These and any additional charges for customs clearance shall be borne by the Customer.

If payment is rejected by the bank, the order will be automatically refused by Edsborg and Edsborg will be released from any obligation and liability against the Customer.

DELIVERY AND RECEIPT OF PRODUCTS

4.1. TERMS OF DELIVERY

Edsborg delivers Products at the delivery address indicated by the Customer according to the delivery option selected by the Customer when placing the order. Customer will bear the consequences (late delivery, impossibility of delivery, Products returned to Edsborg, extra transport costs, etc.) resulting from any incorrect and/or incomplete delivery indications provided and/or Customer’s absence at the time of delivery.

If no estimated delivery date is specified prior to the confirmation of the order, delivery time shall not exceed thirty (30) calendar days from receipt of the order confirmation.

RIGHT OF CANCELLATION & RETURN POLICY

5.1. RIGHT OF CANCELLATION

The Customer has the right, without justification, to cancel any purchase within a period of fourteen (14) calendar days from the day following the day of receipt of the Products ordered. If this period of fourteen (14) calendar days expires on a Saturday, Sunday or a public holiday, it will be extended to the next working day.

The Customer can exercise the right of cancellation by notifying the Customer’s decision and return its Products as follows:

• Either by directly returning the Product.
• Or by returning to Edsborg by e-mail or by postal letter an unambiguous declaration expressing the intention to retract. This declaration must be sent accompanied by the information concerning the Products returned as well as the name, postal address, order number and, if possible, the telephone number and e-mail address of the Customer at the following address:

• The Customer shall, within a 14-day delay as from the date of Customer’s notification of its decision to cancel, return the Product in accordance with the instructions from Edsborg, at the expense of the Customer.

In the event of alteration of the Product resulting from handling other than that necessary to establish the nature and/or conformity of the Product, the characteristics or the proper functioning of the Product, Edsborg reserves the right to refuse the reimbursement or replacement of the Product. Edsborg shall not make any reimbursement if the Products returned by the Customer do not correspond to the Product(s) ordered or has an origin other than the Online Store.

FORCE MAJEURE

Edsborg will not be liable or responsible for the failure or delay to perform any of its obligations caused as the result of an event of force majeure, i.e. an event outside Edsborg’ control and which Edsborg could not reasonably foresee at the time when the contract was entered into with the Customer and the consequences of which Edsborg cannot reasonably avoid or overcome.

MISCELLANEOUS

Should any provision contained herein be found unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these T&C and shall not affect the validity and enforceability of any remaining provisions. The failure of Edsborg to exercise or enforce any right or provision of these T&C shall not constitute a waiver of such, or any other, right or provision. This is the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties.

GOVERNING LAW/DISPUTES

These T&C’s are governed by Swedish substantive law, without having regard to any conflict of laws provisions therein, for the resolution of any dispute. Any dispute shall be finally settled by the competent Swedish courts.
